For example, if a family member was exposed to the fibres and transferred them to you at home or if you lived near a factory where asbestos use was commonplace. There are a number of different illnesses which are, or may be, caused by asbestos exposure, although you cannot claim compensation for them all. They include pleural plaques, pleural thickening, asbestosis, mesothelioma and lung cancer. Advising you on benefits If you have an asbestos-related condition, there are a number of state benefits you
may be eligible to claim, and they are not affected if you bring a claim for compensation. They include Industrial Injuries Disablement Benefit (IIDB), Constant Attendance Allowance and Exceptionally Severe Disablement Allowance. You can contact the Benefits Enquiry Line on 0800 882200 or visit the DWP’s website at www.dwpgovuk Although asbestos is no longer used in buildings, its use was wide-spread from the 1930s to the 1970s and consequently millions of people have been exposed to asbestos at work. Few will develop a disease as a result of their exposure, but those that do are entitled to make a claim for compensation. Many companies knew about the dangers of exposure to asbestos but did not adequately, overall, warn or protect their employees. number of power stations. When he was diagnosed with pleural plaques, we obtained a sum of money for him and, importantly, secured the right to return to the courts should his medical condition deteriorate. When he developed mesothelioma three years later, we brought proceedings against his former employers and obtained an early initial payment of £40,000. The claim was settled a few weeks before trial for £230,000. Using the fast-track mesothelioma court procedure enabled us to conclude the claim only 18 months after he was diagnosed with mesothelioma. l You dealt with us in a most sympathetic and understanding manner and this was indeed a great help to us at this difficult time Case 2 Contact us Another client was exposed to asbestos whilst working as an engineer for British Telecom. He worked in telephone exchanges where hessian bags filled with asbestos were used as a firebreak and was diagnosed with mesothelioma, aged just 59. Unfortunately, our client died before his case
was concluded, but his widow was able to continue the claim. British Telecom admitted that they had been negligent in exposing him to asbestos and compensation of £270,000 was agreed.
